These Terms & Conditions (“Terms”) govern your access to and use of 1002Bikes.com, our products, and our services, including in-store purchases, repairs, and customer support. By using our site or purchasing from us, you agree to these Terms.
If you do not agree, please do not use the site or services. We may update these Terms at any time. We’ll post changes on this page with a new Effective Date.
You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Provide accurate, complete, and current information.
• All orders are offers to purchase subject to our acceptance. We may refuse or cancel an order for any reason, including suspected fraud.
• Prices, product descriptions, and availability are subject to change and may contain errors. We may correct any errors or inaccuracies at any time.
• We accept approved payment methods at checkout. Payments are processed by third-party processors; we do not store full card numbers.
• Sales tax and shipping charges are calculated at checkout where applicable.
• Shipping and delivery dates are estimates only and are not guaranteed.
• Risk of loss passes to you upon our delivery of goods to the carrier. Inspect packages upon receipt and report shipping damage promptly.
Returns and exchanges are governed by our Return Policy posted on our website. Where a conflict exists, the Return Policy controls for return-related matters.
• We may perform diagnostics and repairs based on your authorization. You are responsible for backing up or removing accessories or personal items before service.
• We are not responsible for pre-existing damage, aftermarket modifications, or issues arising from
misuse, neglect, impacts, water damage, or normal wear.
• Electric bikes: Batteries, controllers, and motors must be used and charged per manufacturer instructions. Improper use can cause damage or injury.
• After service, you are responsible for periodic re-inspection (e.g., torque checks, brake adjustments) and safe operation of the bicycle or e-bike.
• Manufacturer warranties (if any) apply to the relevant products; we may assist you in making warranty claims at our discretion.
• EXCEPT AS REQUIRED BY LAW, WE PROVIDE PRODUCTS AND SERVICES “AS IS” AND “AS AVAILABLE,” WITHOUT ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS.
• OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO PRODUCTS OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
You agree to indemnify and hold 1002 Bikes, its owners, employees, and contractors harmless from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the site, products, or violation of these Terms.
• If you submit reviews, photos, or other content, you grant us a non-exclusive license to use and display that content on our site and marketing channels.
• Do not use the site for unlawful, harmful, or abusive activities, including transmitting malware, infringing intellectual property, or harassing others.
All content on the site, including text, graphics, logos, and software, is owned by or licensed to 1002 Bikes and is protected by intellectual property laws. You may not copy, modify, or distribute site content without our permission.
Promotions are subject to terms stated at the time of offer and may be changed or discontinued without notice. Gift cards are not redeemable for cash (unless required by law) and cannot be replaced if lost or stolen.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute will be resolved as follows:
• Binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, held in or near Manatee County, Florida.
• You and we waive any right to a jury trial or to participate in a class action. You may pursue an individual claim in small-claims court instead of arbitration.
• You may opt out of arbitration within 30 days of your first purchase by sending written notice to byron@1002bikes.com.
We may suspend or terminate access to the site or services at any time for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
We may revise these Terms from time to time. The updated version will be posted with a new Effective Date. Continued use of the site after changes constitutes acceptance.
